Regulatory Framework

The Oklahoma Medical Marijuana Authority (OMMA) is the state agency responsible for *"processing commercial and patient license applications, providing customer service to licensees and applicants, facilitating the rulemaking process based on state statutes, enforcing its rules, investigating possible violations of medical marijuana laws, and more." OMMA was previously under the Oklahoma State Department of Health (OSDH) until November 2022, when it became an independent agency [1].

The Department of Agriculture, Food, and Forestry (ODAFF) has limited involvement in the medical marijuana program, but is the lead agency on licensing and regulating hemp cultivation [2].

State Question 788, passed in a 2018 voter referendum, legalized medical cannabis [15]. Recreational marijuana remains illegal in Oklahoma. [3] Possession of small amounts (less than 1 ounce of flower or 6 grams of concentrate) is a misdemeanor, while possession of larger amounts or within 1,000 feet of certain locations can be a felony. [4]

Track-and-Trace

Since September 2020, Metrc has been the statewide seed-to-sale inventory tracking system used by all OMMA licensees to monitor and track cannabis movement from cultivation to sale. [5] [6]

Licensing

OMMA has specific types and processes for licensing both patients and commercial businesses. [7] [8] However in 2023, Oklahoma lawmakers extended a moratorium on new cannabis business licenses until August 2026. [9]

License Type Description
Adult Patient license for Oklahoma residents age 18+. Valid up to 2 years.
Out-of-State Patient license for non-Oklahoma residents of any age with a state-issued medical marijuana license. Valid up to 30 days.
Short-Term Patient license for Oklahoma residents of any age. Valid up to 60 days.
Minor Patient license for Oklahoma residents age 0-17. Valid up to 2 years.
Caregiver License for Oklahoma residents age 18+ to assist a patient with their medical marijuana needs. Valid up to 2 years [10].
Grower License to cultivate cannabis plants.
Processor License to process cannabis flowers and trim into usable products.
Dispensary License to sell medical cannabis products to patients.
Transporter License to transport medical cannabis products between licensed businesses.
Transporter Agent License required for individuals employed by a licensed transporter to transport medical cannabis products.
Testing Laboratory License to test medical cannabis products for potency and contaminants.
Waste Disposal Facility License to dispose of medical cannabis waste.
Research License for institutions to conduct research on medical cannabis.
Education License for organizations to provide "training and education to people involving the cultivation, growing, harvesting, curing, preparing, packaging or testing of medical marijuana." [11].

Patients are also authorized to have 6 mature marijuana plants and the harvested marijuana, plus 6 seedling plants at their residence, following specific growing restrictions [12].

Medical Cannabis

Oklahoma's program allows patients and caregivers to obtain licensure from OMMA, though physicians have discretion to determine if a patient might benefit from medical cannabis [13].
