Regulatory Framework

The Guam Cannabis Control Board (Guam CCB) manages "cannabis for public health, welfare, safety, and taxation purposes." [1]. The CCB is a division of the Guam Department of Revenue and Taxation (DRT) and is responsible for regulating all aspects of cannabis cultivation, retail, and possession on the island, except for personal cultivation as allowed by Guam law [1, 2].

Both Guam's medical and adult-use cannabis programs utilize Metrc for track-and-trace purposes [4].

Licensing

The Guam Department of Revenue and Taxation (DRT) manages adult-use cannabis business licenses [1]. DPH oversees medical cannabis licensing, as well as patient and caregiver identification cards [5].

Medical Cannabis

Patients and designated caregivers can register for the Guam medical cannabis program by obtaining a DPH Information Card and meeting residency requirements. A recommendation from a physician is required, with qualifying conditions including:

  • Cancer
  • Epilepsy
  • Glaucoma
  • HIV/AIDS
  • Multiple Sclerosis
  • Post-Traumatic Stress Disorder
  • Rheumatoid Arthritis
  • Spinal cord injury or other conditions that   causes intractable spasticity
  • Any patient admitted into hospice care
  • Any condition “for which the qualified patient’s practitioner has determined that the use of medical cannabis may provide relief”   [8]

Guam's medical cannabis program offers reciprocity to patients with valid medical marijuana licenses from other qualifying jurisdictions [9].
