Regulatory Framework
The Ohio Division of Cannabis Control (DCC) under the Ohio Department of Commerce oversees the licensing, regulation, and enforcement of the state's medical and adult-use cannabis programs [1].
Legal Status
Market | Status | Statute | Year |
---|---|---|---|
Adult-Use | Legal | Issue 2 | 2023 [2] |
Medical | Legal | Senate Bill 261 | 2016 [3] |
Track-and-Trace
- Ohio has used Metrc for seed-to-sale traceability for medical cannabis since 2017 and has expanded the system for adult-use tracking [4].
Licensing
- As of October 2024, Ohio has begun allowing some medical dispensaries to sell to adults, but has not issued licenses for adult-use specific businesses yet [5]. DCC had previously licensed medical cultivators, processors, dispensaries, and testing labs [6].
Possession Limits
Item | Possession Limit |
---|---|
Adult-Use | 2.5 ounces of flower, 15 grams of concentrates [7] |
Medical | 90-day supply, refillable on 45-day intervals [8] |
Medical Cannabis
Patients can register with the Ohio Medical Marijuana Control Program (MMCP) if they are at least 18 years old, Ohio residents, and have a qualifying medical condition with a recommendation from a state-licensed physician [9] [10]. The program allows registered patients to cultivate up to six mature plants and caregivers to grow up to 12 plants for their patients [11].
